FAMFAM App Data Protection Notice

With this data protection notice, we, the FAMFAM AG, ("FAMFAM", "We") and the FAMFAM Foundation ("FAMFAM Foundation") inform You as a user ("User", "You") of the FAMFAM App ("App") about the processing of Your personal data in connection with Your use of the App and its features as well as about Your rights under data protection law.

Joint Controllership In certain cases (e.g., processing of donation data), FAMFAM AG and the FAMFAM Foundation may act as joint controllers pursuant to Art. 26 GDPR. In such cases, they have entered into a joint controller agreement that transparently defines their respective roles and responsibilities in relation to the processing of your personal data.

2. Provision and Use of the App

2.1 Description and Scope of Our Data Processing

When You use the App and its functionalities, We automatically process in particular the following data:

  • IP Address
  • Operating systems
  • Device models
  • Geography
  • Time zone

Note: When You download the App, information is also processed by the respective app store (e.g., Apple App Store, Google Play Store), in particular the username, email address, and customer number of Your respective app store account, time of the app download, payment information (if any), and the individual device identification number. In addition, the respective app store collects various data independently. We have no influence on this data processing by the app stores and are not the data controller for such processing.

2.2 Purpose of Data Processing and Legal Basis for Data Processing

The collection and processing of Your personal data is necessary to enable Us to provide You with the App and its features. The legal basis for the processing of the data is Art. 6 (1) lit. f) GDPR (legitimate interests). Our legitimate interest is the provision of a functional app and ensuring its stability and security.

2.3 Duration of Storage

We delete Your data 6 months after the end of Your respective use of the App.

2.4 Recipients of the Data

We use Amazon Web Services EMEA SARL, 38 Avenue John F. Kennedy, L-1855, Luxembourg, Google Cloud EMEA Limited, 70 Sir John Rogerson's Quay, Dublin 2, Ireland, and 650 Industries Inc, 420 Florence St, Suite 200, Palo Alto, CA, USA, as technical service providers for the provision and operation of the App.

3. Registration and FAMFAM User Account

3.1 Description and Scope of Data Processing

To use the App, You have to create an individual FAMFAM user account ("User Account"). In Your User Account, You can manage Your settings. For the creation of a User Account, We ask You to provide the following data:

  • Name
  • Email address
  • Gender
  • Date of Birth
  • Address

After the registration of a User Account, We process Your email address every time You log in to the App. You may also add optional information such as a user name and a personal profile picture.

3.2 Purpose of Data Processing and Legal Basis for Data Processing

The data You enter during the registration and log-in process is processed for the purpose of identification, age verification, and authentication in order to provide You with secure access to Your User Account. The legal basis for the processing of personal data is Art. 6 (1) lit. b) GDPR (fulfillment of a contract, e.g., FAMFAM terms of use).

3.3 Duration of Storage

We process Your data as long as You use the App. We will close Your User Account if We do not register any activity on the User Account for a period of two (2) years and will delete the data in the User Account subsequently. Nevertheless, We may store Your data beyond the closure of Your User Account if We are legally obliged to store this data.

3.4 Deletion of Your User Account

You may request the deletion of Your User Account at any time by contacting us at support@famfam.app. We will process your request and delete your account, including associated personal data, within sixty (60) days, unless we are legally required to retain certain data for a longer period (e.g., for tax or accounting purposes). After deletion, you will no longer be able to access the App or Web Profile, and any associated content, guest list entries, donation history, or tickets will be permanently removed or anonymized.

4. Using Services and Features of the App

4.1 Description and Scope of Data Processing

The App provides various services and features which You can choose to use (e.g., applying for a placement on a guest list, using interactive maps). If You choose to use these services and features, We will collect and process the required data to enable You to use the services and features. Such data may include payment data if You choose to use a paid service or feature.

4.2 Purpose of Data Processing and Legal Basis for Data Processing

We process Your personal data to enable You to use the App feature You choose to use. This processing may include the transfer of Your data to third parties (e.g., promoters, clubs, or map providers). The legal basis for the processing of Your data by FAMFAM is Art. 6 (1) lit. b) GDPR (fulfillment of a contract, e.g., FAMFAM terms of use).

4.3 Duration of Storage

We store Your data only as long as this is necessary in relation to the purpose for which Your data was collected or We are legally obliged to store the data.

4.4 Data Sharing with Third-Party Promoters and Event Organizers

In connection with event registrations and ticket sales, We may share Your personal data (such as Your name, email address, and registration details) with third-party promoters or event organizers. This is necessary to facilitate Your participation in events, manage ticket sales, and provide related event communications.

These third parties act as independent data controllers upon receiving Your personal data and are responsible for processing it in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR) and the South African Protection of Personal Information Act (POPIA). You may also receive direct communication from these third parties about this event and future events. We ensure that such data sharing is conducted transparently and lawfully. 5. Donations to FAMFAM Foundation

5.1 Description and Scope of Data Processing

FAMFAM is an innovative platform dedicated to music enthusiasts, curating a vibrant blend of music, fashion, and art that embodies the contemporary spirit of our age. At the heart of FAMFAM lies Our commitment to social impact through the FAMFAM Foundation. The FAMFAM Foundation is dedicated to fundraising for lasting projects aimed at providing underprivileged children and teenagers with access to professional environments that nurture and elevate their creative potential. You can make a donation to the FAMFAM Foundation via the App. For making a donation to the FAMFAM Foundation, You have to enter the legally required personal data in the App (name, address, date of birth, and payment information). You can make the donation directly in the App via a payment interface.

5.2 Purpose of Data Processing and Legal Basis of the Data Processing

We process Your personal data to enable You to make the donation to FAMFAM Foundation and to provide Your data to the FAMFAM Foundation. The FAMFAM Foundation further processes Your data as data controller to issue a donation receipt. The legal basis for the processing of Your data by FAMFAM is Art. 6 (1) lit. b) GDPR (fulfillment of a contract, here: FAMFAM terms of use) and by the FAMFAM Foundation is Art. 6 (1) lit. f) GDPR (legitimate interest) whereas its legitimate interest is to collect donations in line with the foundation purpose.

5.3 Duration of Storage

We and the FAMFAM Foundation store Your data only as long as this is necessary in relation to the purpose of processing Your donation or We are legally obliged to store the data.

5.4 Recipients of the Data

For processing Your donations to the FAMFAM Foundation, We use Stripe Payments Europe, Limited, 1 Grand Canal Street Lower, Dublin, D02 H210, Ireland as a payment provider.

6. App Analytics

6.1 App Analytics

We use technical data on Your use of the App to analyze how Our users interact with the App and its features and to improve the App and its features. For this purpose, We use the following third-party analytics tools:

Consent for Analytics Where required, we collect your consent via an in-app prompt or settings toggle before enabling the relevant analytics tool. You may withdraw your consent at any time via the App settings.

6.2 Legal Basis of the Data Processing

The legal basis for the processing of Your data is either legitimate interest (Art. 6 (1) lit. f) GDPR), whereas Our legitimate interest is to provide an App which meets the user expectations, or Your consent (Art. 6 (1) lit. a) GDPR). If the use of a third-party analytics tool requires Your consent, We only use such tool if You have given Us Your prior consent.

6.3 Duration of Storage

Google Analytics for Firebase: Your Data will be stored for a maximum period of 14 months.

Sentry: Your Data will be stored for a maximum period of 90 days.

7. Data Subject Rights

If Your personal data is processed, You are a data subject within the meaning of the GDPR. As a data subject You have the following rights under the GDPR:

  • As a data subject, You have the right to obtain confirmation as to whether or not personal data concerning You is being processed by Us and, where that is the case, the right to obtain information about the personal data stored about You and a copy of it (Art. 15 GDPR). If incorrect personal data is processed, You have the right to rectification (Art. 16 GDPR). 9. Necessity of the Provision of Personal Data
